Terms of Service

These Terms of Service ("Terms") govern your use of TICKR, a trading journal and analytics service operated by Bryan Mota("TICKR", "we", "us"). By creating an account or using TICKR, you agree to these Terms. If you don't agree, don't use TICKR.

1. Eligibility and your account

You must be at least 18 years old to use TICKR. You're responsible for the information you give us, for keeping your password secure, and for everything that happens under your account. Tell us right away at tickrjournal@gmail.com if you think your account has been accessed without permission.

2. What TICKR is — and isn't

TICKR helps you record, review and analyze your own trading activity. TICKR is not a broker, investment adviser, commodity trading advisor or financial planner, and does not provide investment, financial, tax or legal advice. Statistics, discipline scores, rule checks and AI-generated reviews are educational tools based on the data you provide. They are not recommendations to buy or sell anything. You alone are responsible for your trading decisions. See our Risk Disclaimer.

3. AI features

Some features use third-party artificial intelligence to generate feedback on your trades and journal. AI output can be incomplete, inaccurate or inappropriate for your situation. Don't rely on it as the sole basis for any decision.

4. Plans, billing and renewal

  • TICKR offers a free plan and a paid Pro plan, billed at $19.99 / month or $149.00 / year, plus any applicable taxes.
  • First-time Pro subscribers get a 3-day free trial. You must provide a payment method to start it. Unless you cancel before the trial ends, your subscription starts automatically and your payment method is charged for the plan you chose.
  • Paid plans renew automatically at the end of each billing period at the then-current price until you cancel.
  • Payments are processed by Stripe. We don't store your full card details.
  • We may change prices with advance notice. A price change takes effect at your next renewal.
  • If a payment fails, we may limit Pro features until it's resolved.

5. Cancellation and refunds

You can cancel anytime from the Billing page. When you cancel, you keep Pro access until the end of the period you've paid for, and you won't be charged again. All payments are non-refundable, including for partial periods and unused time, except where required by law. See our Refund Policy.

6. Your content

You own the trade data, notes, screenshots and other content you add to TICKR ("Your Content"). You give us a limited license to store, process and display Your Content only as needed to run TICKR for you, including sending it to our service providers (such as our AI provider) to generate the features you use. You're responsible for having the right to upload Your Content.

7. Acceptable use

You agree not to:

  • break the law or infringe anyone's rights while using TICKR;
  • access other users' data, or probe, scan or test the security of TICKR without permission;
  • interfere with or overload the service, or use bots or scripts to access it outside its normal interface;
  • copy, resell or reverse-engineer TICKR, or use it to build a competing product;
  • share your account or let others use it.

8. Availability and changes

We work to keep TICKR running and your data safe, but we don't guarantee the service will be uninterrupted or error-free. We may change, add or remove features. Keep your own copies of anything important, such as your broker's trade exports.

9. Termination

You can stop using TICKR and ask us to delete your account at any time. We may suspend or end your access if you violate these Terms or if we stop offering the service. If we end the service without cause, we'll give reasonable notice.

10. Disclaimers

TICKR is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that any calculation, statistic or AI output is accurate or complete.

11. Limitation of liability

To the fullest extent permitted by law, TICKR and its operator won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any trading losses, lost profits, lost data or business interruption, arising from your use of TICKR. Our total liability for any claim relating to TICKR is limited to the amount you paid us in the 12 months before the claim arose.

12. Indemnity

You agree to defend and hold TICKR and its operator harmless from claims arising out of your use of TICKR, Your Content, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Alabama, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms. If a change is material, we'll notify you by email or in the app before it takes effect. Continuing to use TICKR after that means you accept the updated Terms.
